In appeal or revision, the Superior Court may set aside the judgment and Order and send the case for fresh trial.

1. Md. Abu Taleb, Criminal Revision No. 471 of 2021

   The Accused was convicted under Table 9(Kha) of section 19(1) of the Madhak Drabbya Niyantron Ain, 1990 and was sentenced to suffer imprisonment for a period of 5(five) and also to pay fine of Tk. 5, 000/- by the trial Court. He filed criminal revision before the High Court Division. The High Court Division sent the case for retrial.
